Hi there, My father is 71 and lives in Brazil near to San Paulo. His wife has just filed for a divorce and has asked for half of everything . My father went into the marriage with a good amount of money and she had nothing. She has not working during their 17 years of marriage . She stole $30,000 out of his business account about 4 months before she told him she wanted a divorce. He has no money as it's all tied up in property which he has not been able to sell due to the falling house market and recession.. She also told him she wants half of the house in Malta which he owned before he met her.. She has kicked him out of his own house under grounds that he shouts a lot ( he does ) but now he is alone and speaks no portuguese in Brazil and living in one of the properties that he owns there .. but it has only a mattress and no fridge or anything else . He also has an 14 year old daughter with her and is worried she will be taken way from him .. I'm trying to work out what the law is for custody of the child and work out what she is entitled to. I believe he offered her half the family house and said he would pay allamony but she wants half of everything .. I'm really at a loss of what to do. On top of all this her cousin is a lawyer and I know Brazil is very corrupt. I would hate to see my dad loose everything he has worked all his life for .. Any advice ? He is a british national and they got married In UK but moved to brazil about 9 years ago..
Thank you

Your Dad needs urgent help from an honest heavy hitter lawyer it appears. I have a best friend in SP who owns his own firm that I trust completely. The only attorney I have met in 13 years where I can say that. He is specialist in real estate law but not sure if includes divorce actions. I have written him about your case and will advise here if his answer is yes. And or a referral he trusts to help you and Dad. He speaks and writes English very well. Find out if Dad's marriage in Brazil gave his wife rights to property beforehand. It can include that or just assets acquired after the marriage. This of course will effect her rights to his property in Malta or elsewhere before the marriage.

He should go to the British Consulate for advice. They have lawyers that can help him understand how he should go about all this. Brazilian legislation is good and it will work if you know what the right channels are. He should find a trustworthy lawyer but it seems to me he does not know how to handle Brazilians. As mentioned above, I would start at the British Consulate. Alternatively, there is an excellent, reliable English-speaking lawyer in Florianopolis who might be able to suggest something. His name is Dr. Carlos. He has professional connections in SP. www.zoegacoelho.com.br
Good luck!

I spoke to my lawyer friend Andre today, his firm handles divorce and property issues every day so obviously he can help you if you like. I started helping foreigners invest here in Brazil after having issues my self and watching virtually every one in my area get taken in some way. I have a lot of experience with lawyers therefore and Andre is the only one I would go out on a limb to suggest. He is right there in SP, and knows the game at the highest level there and internationally. He asked that you call him. I will private message his personal phone number and details. Anyone else interested can private message me for it as well. His website which has a section with his Bio and expertise FYI: www.rbadvogados.com.br All the best wishes for your Dad.

I would advise before hiring any Brazilian lawyer your dad should visit the British Consulate in São Paulo. They could provide Good advise on how to proceed as well as References about lawyers specialized on International family/ private law.
