Same-sex couple looking to move

My partner (who is a dual citizen between Italy and the US and is living here in the US) and myself (a US citizen residing with my partner here in America) are married in the US (same-sex couple) and are looking to relocate to Rome.

I understand that we have to get our marriage certificate translated and that my partner must register it in Italy.

What we are unclear about is how to go about relocating to Italy. Every site I see explains how to do it if your Italian spouse is already living in Italy (via a family visa). But mine is not. So, while my partner could easily just pick up and move to Italy, I don’t know which visa process I should do in order for us to move together.

Someone else on another forum mentioned that they would have to move first and set up residency and then I would apply to join him. But that definitely doesn’t seem right, not logical. It would require being apart for what could take many months or over a year. So, I’m looking for some firm guidance.

As Italy does not recognize same sex marriage, but does recognize civil unions, your search should start with rules specific to that.

Not to worry. The spouse of an EU citizen has the right to be with his/her spouse. No need to wait. Just go together and when you get there start the Permesso di Sogiorno process while your partner registers for residency. Once you have your P di S then you could apply for residency. Your partner could apply for the health card as soon as he applies for residency and the same for you. You may consider getting supplemental health insurance for the gap that you are going to have to wait. that's going to be several months. However, if you are healthy, you are not forced to buy the insurance. Medical care is relatively cheap for routine stuff.

One more thing. Make sure all your documents are in an acceptable form, apostille and "legally" translated.

Thank you for the info. It's my understanding that the PdiS must be applied for before moving to Italy at a consulate in my home country. Is this not true?

For marriage certificates, you will need to obtain the Long Form. This will include information about your respective parents. You cannot get the Long Form through the usual online requests.

You apply for the PdiS once arriving in Italy. You have 8 days from the day of arrival. Go to the nearest main post office and pick up the package to apply.

Maluzza86 in this case it's a bit different. The application is done directly at the questura, bypassing the post office. The 8 day requirement also does not apply but the sooner you do it, the sooner you can get residency. As far as going to the consulate, you can but who wants to deal with those people. Just make sure all your docs are in order.
