Hi All! Mt partner (who is from Venezuela) needs to renew his tourist visa. If he flies to Guatemala (he can't go to the US), is there a required amount of time he has to stay there before returning on a new tourist visa? Thanks!

There is no time limit, but his re-entry will be entirely up to the immigration officer he encounters upon his return. There are no set parameters that I know of.

Yes, some have been denied re-entry to Mexico, which is entirely up to the discretion of the agent you encounter at the border. He may note that you appear to be living in Mexico with only a tourist permit. As such, he may decide that you should be “encouraged“ to return to your home and visit a Mexican Consulate to apply for a residence visa. It is within his authority to do that; or to deny you if you just don‘t look right to him......or if he had a bad day at home. You cannot argue with them, and there are no guarantees that anyone must be admitted into Mexico. If that should happen, there is nothing you could do to change the situation; other than making it worse......probably for both of you.

You're, absolutely, right about that RVGRINGO! And what if someone in that agent's family or a friend has been mistreated by ICE or CBP, ostensibly the US? Decisions have consequences and in this case, a very bad decision is, more than likely, going to have, equally, as bad, if not worse consequences. I have the very bad feeling that it's going to get a lot tougher going both ways. Things DID NOT have to get to this but, when you don't think and just react or act emotionally, the results, usually, aren't good. I wish the best for everyone on both sides and all of you/us Expats better have all papers in order (even though that may not even matter) but, I'm afraid we've got the wrong administration who doesn't really care either way.

Does anyone know how 401k is treated when applying for permanent residency. I am not eligible to take money out without a penality yet. I don't have $1400 in monthly income either.

I used my 401(k) balance to meet the assets requirement when applying for my Residente Temporal. The Los Angeles consulate had no issues with that. However, it took them a couple of hours to get satisfied with the monthly balances, since I only receive quarterly statements.
