Good evening!

I have scowered the internet and have found in very difficult to find someone in the same situation as me and all the visa websites have nothing on what I;m after, Basically,
My fiance and I want to move to America (california) , he has been living in the uk for 3 years as he moved from the us (Nebraska) he has dual citizenship his mother being English and father being American military man, Now he can obviously legally get into the country and yes we are engaged but we were looking online and you have to apply for the visa from the place you got married and we don't really want to get married in England or you have to get married within 90 days of receiving your immigrant visa but we don't want to get married that quickly either and I don't want it to seem like we are getting married for that reason ( we have been engaged 6 months and have only solidly made this decision the last couple of weeks) and on another note my aunt has her own business here in the u.k and we are planning to open a US branch which I would be in charge of ( which eventually would need an employee or 2) but have no idea how well it will do at first or how we would even set it up or initial investment, I currently am setting up my own side business for income which seems like it will do well but yet to really know, I am just after advice on what visa I should apply for or any general advice! damn I am so stuck haha, thank you for any one who can help :)

You need the services of an Immigration Lawyer.

First question...are you and spouse both white? My advice is contigent on that in particular since America is patently xenophobic and racist...

Hello, Hiring a lawyer is the best idea and the price range can vary greatly depending on the location and experience of that lawyer...From my experience the best thing to do is get married in the USA, you'll avoid a lot of headaches trying to get a Visa later on.
It seems other people are just wasting time with comments about UK citizens can come and go as they please. Most UK residents can visit the USA for 90 days I think but not be a US citizen.
The white comment was completely stupid and uncalled for. Yes there are some racial issues but it is actually easier to get things if you are not white, the USA has a lot of laws to benefit minority races before the majority but I do not think that a Visa is on that list.
Good luck with your move, I hope you can find what you need.

Ive been through this twice, came to the US with a biz visa from UK, got married applied for green card , got that, divorced US wife , revoked green card and left US . Met and married in US an American lady, my present wife, i had a B1 visa, so could stay 6 months at a time , we hired a good immigration attorney and applied for a CR 1 , takes atleast a yr, got my green card in Oct. Theres a lot of hoops to jump thro. You can also apply for a fiancees visa , remember i was already married. Good luck I can give you name and contacts for a good attorney

Easier and less expensive to get a fiance visa. He will need to show a certain minimum level of income in order to sponsor you. Process could take from around 4-12 months to get it approved. Why not begin the process now, or wait until you are ready to get married within 90 days?

Hi . Your fiance can apply for a K1 visa for you, but you have to marry within 90 days of coming to the US , you can then apply for a green card after your marriage to stay permanently , marriage to an American resident doesnt give you residency .
