Expat Returns to States, what about ACA?

My wife (aged 75) is returning to the States for a kids visit for the first time in 3 years. We have local health insurance here in Panama but I don't think it is ACA compliant. She didn't sign up for Medicare Part B when she started getting Social Security benefits. What do we have to do if she's staying in Calif. for 5+ months? Will we get dinged if she doesn't do anything at all? How do they track this stuff? All advice would be appreciated.

Who knows these days. If she is an American citizen she is probably screwed. If she is Mexican or Panamanian she may be OK. Under the law last month she does not have to comply if she is in the States for no longer than 33 days per year. I f she is there longer than that then she loses her foreign residency status. Not sure but I think this is tracked thru filing of income tax and passports. If she has permanent residency here this may come under tourist visa staus if she is not employed. Good luck! I think I would call the FBU at the US Embassy and ask.
