I just did 7th Visa for someone who had a felony... I live in Quito and my Ecuadorian wife went to school with some of the supervisor's at the Immigration Office... This is what they are looking for ... 1st 2nd 3rd degree Murder... or Manslaughter related deaths.. Child Molestors, or Rape... If you have any of these related crimes I would not suggest you coming.. If its a minor drug felony charge like Marijuana,Cocaine, Heroin, then I can get them to over look that. My suggestion is do what everyone else has been doing that have felonies.. Go on line and order the report on yourself without felonies.. Just order the report that have misdemeanor's , and traffic infractions. Then take it down to the Secty of State and Apostile it then call me at 239-234-4428 or email me at [email protected]........ Sometimes its not what you know its who you know in Ecuador... Be Creative.... If theres a will theres a way... How do you think the Colombians and Cubans are doing it everyday... Cuba will not even take back there own people that have over extended there stay Once there Visa runs out they are done ... I see Cubans everyday at Immigration trying to leave back to Cuba.. They will not allow them back in Cuba unless they have a valid passport... They are stuck here in Ecuador... They have no country.... The President let them in 4 years ago and now stuck with all these Cubans that have no jobs and have no legal status papers..

There is no time limit. They want to know if you have EVER had a felony conviction, and yes, they will deny you a visa for that reason. If you can get a police report saying your record is clean, then they won't do anything to verify it. They have been askig in some cases for police reports with fingerprints that have been run through the FBI. I know you want a definitive answer on this, and you deserve that, but its really difficult when nothing is black and white here. What one official says, may be totally different from what the guy in the next cubicle will say. Nothing is uniform here and it can be extremely frustrating. I can't tell you how many times I've seen people sobbing in the visa office after getting mis-information, or requirements have changed, or they can't get a straight answer

Francisco, the fact that they both had, basically the same info, didn't affect the rules of the Japanese government (the entity hiring him.)
I don't currently live in Ecuador, so I don't have a say in welcoming people into the country.
But I think I'd want to know what KIND of a felony conviction an individual had, before offering to help him/her skirt the law in getting into my adopted country.
I'm just saying.

I would get the report and send it to the Ecuadorian consulate nearest where you live. They have the final word, but if you are not wanted, you should be fine.

$3500.00/mth. ??? From what I have been reading on all Ecuador boards,blogs etc. you should live very comfortable on your income.
As far as your criminal background check I don't believe that will present a problem for you.

I just want to add, that I am in no way trying to flee from the law. all my punishment was served over 7 years ago, and I had all my rights restored. I am just trying to find a nice place to retire to so I can enjoy myself, and make my money go a little further, doesn't have to be much further because I have a pretty good income of around 3500 a month.
the police certificate issue is perplexing and i just don't want it to hinder me. so that is why i am worrying about it
any further info is greatly appreciated, and i'll probably be asking tons of questions, so i ask for patience.

Margaret's right and characterizes it aptly. Just go to your local police station and take what they give you. You'll be fine. In Miami, the PD told me that they just look to see if you have any local convictions or charges.

My take on this whole thing is...it's no big deal as long as you can provide a Document saying that you are not a criminal. Now, I do know that there ARE gringos living here, that are even 'wanted' in the US, and how they got to live here.....well, that is why I would say do not worry.
Try to get a certificate from someplace where you have lived stating that you are not a criminal....I do not think they would go back too far. I really think this is tenuous and subject to 'minute by minute interpretation' much like the rest of Ecuador is run! The Ecuadorians love DOCUMENTS even if they are out of date! IMO. I know my info sounds vague, but, give it a go, get something, anything, and I am sure you will be able to get a visa to live here, especially if you are investing $$$ here.

If your first statement is true, why would he need to provide checks in 2 states?
Fact is, the first statement isn't true in all cases and it definitely depends on what kind of background check you get. If you're interested in what different kinds of background checks are available, you can look that up elsewhere. An NCIC check is vastly different from the check your local police department will do.

Data sharing means that your background check will show up any record.
I did misuse the term "capital".
If you want to know how far back it will go, you will need to ask the Ecuadorian embassy how far back it HAS to go.
Which, of course, doesn't mean that you will get the same answer twice.
My DS had to get a criminal search to teach in Japan. Because he'd lived in two states in the five years prior, he needed them from both states.
We were told that everything more serious than a parking ticket would show up.
Since he hadn't owned a car, it wasn't an issue for him.

A criminal background check is just that: if you have a record, it will show up.
It's unlikely that a conviction for a capital crime will not show up, even if the check is done in a different state, as databanks are shared between states.

so, if all i need is a state police check, how many years back is required? ifetime? 10 years, 5 years?

From what I have been told you can get everything you need from your state police.
