Visa application via Colombian child.

Update,

Here is a correspondence with my attorney in Medellin in regards to my pursuing a visa via my child. Long story short it is not possible in my case; although, the attorney as you can read would be happy to pursue the case.

I will wait and see how things shake out. I am not interested in becoming a tax resident anyway in all likelyhood and the only plus of the visa is to get on my wife's insurance, which IF I was above board about my income would be 12.5% of my monthly income and very expensive for what ya get.

Me permito informar que la nueva Resolución de visas 5477 de 2022 entra en vigencia el día 21 de Octubre de 2022 y al momento de su publicación incluyó muchos cambios no previstos en los "borradores" antes publicados.
Como les había indicado antes, la visa a la cual puede aplicar el señor Xxxxx ya no es Tipo R - Residente sino tipo M- Migrante la cual se otorga hasta por tres años.
Algo importante para tener en cuenta, es que el Ministerio de Relaciones Exteriores incluyó varios requisitos adicionales para este tipo de visa, entre los cuales :
Articulo 70 - Numeral 3 : El padre o madre extranjero(a) deberá aportar la visa de la cual era titular y que se encontraba vigente al momento del nacimiento del menor de edad.
También en el parágrafo de dicho artículo se resalta nuevamente este requisito : "en todo caso, la autoridad de visas e inmigración verificará que al momento del nacimiento del menor los padres hayan sido titulares de visas que otorguen domicilio"
Lo anterior, son requisitos que consideramos inconstitucionales, pues violan el derecho a la familia de un menor y restringe otros derechos, no obstante, es la norma que rige en la actualidad y por lo que sé del caso del señor Xxxxx Xxxxxxxxx al momento del nacimiento de su hija, no era titular de ningún tipo de visa por lo que no cumpliría con uno de los requisitos indispensables para esta solicitud.
Lo que podríamos hacer es adelantar la solicitud, explicando todo el contexto del nacimiento de su hija y argumentando jurídicamente que se está violentando un derecho, sin embargo, es posible que ellos no lo tengan en cuenta e admitan o rechacen la solicitud.
Así las cosas, quedo pendiente de que me indique si de todos modos desea intentarlo.
Podríamos analizar la opción de visa para cónyuge de nacional colombiano, si no recuerdo mal , la señora Xxxxxx es Colombiana.
