Attorney for Immigration & more

Ciao amici,
I'm looking for recommendations for immigration attorneys, preferably someone in the States or in Sicily. My (soon-to-be) husband and I own a property in Sicily and I want to live there FT but he does not. (Not always living in the same place is one of the secrets of our 17-year relationship, but he will come 2 or 3 times a year and stay 2 or 3 months at a time.) He will retire this year and we are wondering if I will qualify for an elective residency visa under our shared assets or if we will both have to apply for a visa. And then there are a few other tricky questions we have.
We do have the attorney we used when purchasing our home but I'm not sure immigration is his specialty and would like to talk to others. Any recommendations are greatly appreciated! Grazie!

For someone who 'owns' property in Italy I'm surprised you know so little about Visa requirements. Go to your nearest Italian consulate (you may need to make an appt and some on this site have said appts are VERY hard to get and may take months) and find out the requirements for an ER Visa...it is a long process, lots of docs, paid health insurance, proof of c. $30K+ in the bank and much more. You can see most of the info on the consulate website...different states may differ. Owning property makes little or no difference in obtaining the Visa. It does make it easier to prove you have a place to stay...which is also one of the requirements for the Visa. Once arriving in Italy you then (within 8 days) need to apply for a Permesso di Soggiorno....lots more docs and bureaucracy....then after a few months you can apply for residency which is needed to obtain Italian Health Insurance. All this may take over a year....start to finish...just take it step by step and don't get discouraged. Hopefully you already have your Codice Fiscale in your PASSPORT name...not maiden name. You will need that for almost everything in Italy...you can get it at the consulate also. Nope, don't need an attorney at this point. After 5 years in Italy you may be able to look into long term residency (not the usual 1 or 2 year renewable) or citizenship. If you have Italian grandparents/parents....google Jure Sanguinis....that would be your only short cut and yes you would need an attorney. Good Luck

You really do not need an immigration attorney. The process is pretty straightforward. Yes. you do apply separately, but your documents will indicated you are married. Your husband has no need of a visa if he is going to just spend 90 days. I have left all our how to posts and links to relevant agencies, on, www,theslowtourist.com no ads, no cookies. Not selling anything. Just the breadcrumbs of two Americans who have gone through this entire process.

CodyBrandy: I already know EVERYTHING you wrote. EVERYTHING. You shared nothing I do not already know. I never implied that owning property made it easier. You clearly did not understand my question, so I won't bother repeating it. And this, my friend, is why I need an attorney. Please note that I did not ask for anyone's advice - I only asked for names of attorneys.

rsetzer99: Thank you for your kind reply. I have looked at The Slow Tourist in the past - it is a lovely site. And I appreciate you answering my specific question. I do not have the assets required to meet the visa requirements on my own, which is why we have been concerned. And currently, his assets are not in my name. (with the exception of us owning the Sicily property together) Since we both live 8 - 12 hours from the nearest consulate, we don't want to make our appointments until we are completely clear about this. I will continue to check back on your website - and I will continue to look for an attorney as well. Thank you again.

Just a note, on November 23, 2023 all U.S. citizens will need an
ETAIS visa to enter Europe....so, check it out.

The only assets of concern to the consulate are the guaranteed income. A place to stay is part of the package, but the paramount part is the income. Yes, it can be considered as a combined amount for married couples.
