Real estate Attorney

Hello, I am moving to Rosarito into a nice prestablished community where they are and have been building homes for years now. Do I need a real estate attorney or will a real estate agent make sure everything is settled properly?

Your question indicates to me that you need to do a *lot* more reading before you venture out or you will certainly get fleeced out of your deposit.

The real estate market is nothing like the US here, and every assumption you have needs to be checked at the door.

To answer your immediate questions, no you can't count on a real estate agent. At all. They are not representing you, have no professional, ethical or legal obligations to you, and likely have no legal training whatsoever. There are no 'buyer's agents' here. There is no MLS, no state-standard P&S agreement, and no escrow agency.

I have bought a few properties in Mexico. My advice is talk to expats in your area and have them put you in touch with good realtors. Some realtors are very knowledgeable and some not so much. The process is different for sure but find someone to give you good advise in your target area. Attorneys can tell you also but don't have multiple properties to show you.

I agree, the real estate transaction was dissimilar to that in the US. We did use an attorney who handled the offer contract and all the filings needed.
