Accident

Suffered a small set back this week when my bicycle and I were tossed into the street by a horse. Owner of horse admitted responsibility. Police report. All well and good. I was banged up pretty well although nothing broken. Nothing a few weeks of not working won't likely cure.
Questions is this: Do I need a lawyer?
Call to insurance company was not pleasant as the agent inferred that I must have scared the horse. I have medical bills to pay and cannot work.
Advice would be welcomed.
