Help or Advice needed

Hi, my husband and five children are relocating from Australia to USA. We were meant to have a visa approved prior to departure which was Dec 22nd 2012 and we are still waiting. We are staying in the US on ESTA. We have a lawyer who resides in the states and have already paid him $10 000 and still waiting on the visa. We have applied for an E2. Any advice would be very helpful?
